Jail or bail? Delhi High Court's big decision on Arvind Kejriwal will come today

 

A 29-page written reply was filed by ED in Delhi High Court. ED opposed granting bail to Arvind Kejriwal in the liquor scam. ED said that the bail granted to Kejriwal by the lower court is illegal. In the reply filed in the High Court, ED gave 13 statements of hawala operators and AAP workers of Goa as evidence.

The Delhi High Court will give its verdict today on the petition filed by the Enforcement Directorate (ED), seeking a stay on the lower court's order granting bail to Chief Minister Arvind Kejriwal in the excise policy case. Justice Sudhir Kumar Jain will pronounce the verdict at 2:30 pm. CM Kejriwal was granted bail by the lower court on June 20. On June 21, the ED moved the Delhi High Court challenging the grant of bail to the Chief Minister.

Meanwhile, the central investigating agency filed an urgent application to stay the impugned order. Delhi High Court Last week, vacation judge Justice Jain heard the ED's plea on Friday. While reserving the decision on the stay application, the court ordered that the impugned order will remain stayed till the pronouncement of the order.

After this, CM Kejriwal approached the Supreme Court challenging the stay granted by the High Court. The case was heard on Monday by a vacation bench headed by Justice Manoj Mishra, which adjourned the hearing till June 24.

However, the Supreme Court orally observed that the Delhi High Court's approach in reserving the order on the ED's stay plea against Arvind Kejriwal's bail was "a bit unusual".

ED said that the lower court gave the decision ignoring the evidence and facts presented before the court. It is illegal for ED not to get a chance to present its side as per section 45 of PMLA.

Meanwhile, Arvind Kejriwal filed a reply in the Delhi High Court. Arvind Kejriwal filed a reply on the ED's allegations and said that ED does not have a single proof of spending money in the Goa elections. The Enforcement Directorate does not have a single proof against CM Kejriwal. Witnesses have been made to give statements against Kejriwal as part of a conspiracy by giving the lollipop of bail.

The hearing was adjourned as the Supreme Court said it did not want to “pre-judge” the issue while awaiting the High Court order.
