No religion encourages increasing pollution… Supreme Court's strict comment on burning crackers.

 

The hearing on the bad air in Delhi-NCR is going on in the Supreme Court. Meanwhile, the apex court has said that no religion encourages increasing pollution. If firecrackers are burnt, there is no clean air, which is a violation of Article 21 i.e. the right to life. The Delhi Police Commissioner should give this affidavit personally by November 25. It has said that the court directs the Delhi Police Commissioner to file a personal affidavit, in which the steps taken by him to implement the ban on firecrackers should be put on record. We direct all NCR states to come before us and inform us about the steps taken by them to keep pollution to a minimum.

The Supreme Court said that we direct the Delhi Police Commissioner to form a special cell to ensure the effective implementation of the ban on firecrackers. We wonder why the Delhi government delayed the ban till October 14. It is possible that users would have got stock of firecrackers before that. Under Article 21, there is a right to live in a pollution-free environment. Prima facie, we believe that no religion promotes any activity that promotes pollution or compromises the health of the people.

What steps have been taken to implement the ban, SC asked

While beginning the hearing, the Supreme Court asked who appears in the court on behalf of the Delhi Police and the Delhi Government? Show us the order banning firecrackers and the steps taken to implement this ban. The lawyer of Delhi Government showed the order where firecrackers were banned. Justice Oka said, then your affidavit says that you will ban firecrackers only during Diwali and you will not do so during wedding and election ceremonies.

The Delhi government's lawyer said that your instructions for a permanent ban will be considered after consultation with all stakeholders. Senior advocate Gopal Shankarnarayan said that the ban is not only in the case of Diwali, but it is a permanent ban across the country. Even online sales are banned. I used to get a lot of messages. This court has directed the manufacture of green crackers. This is not limited to Delhi only, but across the country.

SC asked, why is the ban on firecrackers limited only to Diwali?

The Supreme Court expressed displeasure at the Delhi government and Delhi Police. Justice Oka said that let your stakeholders come to us. If someone is claiming the right to burn firecrackers under Article 21, then let them come to us. Justice Oka said why is it limited to Diwali only? Why not be alert beforehand. The central government said that the Delhi government issued instructions on October 14, just two days after Dussehra. Nothing was done before that.
