We cannot call any part of India Pakistan, CJI said in the comment of the HC judge.
Supreme Court Chief Justice DY Chandrachud said that no part of the country can be called Pakistan. Chandrachud made this comment during the hearing of a case of a judge of the Karnataka High Court. Recently a video of Karnataka High Court judge Srishanand went viral in which he was calling a place associated with a community as Pakistan.
The Chief Justice further said that people in responsible positions should think before speaking and that their comments should not hurt the dignity of any community. He said that judges should take special care of this.
What happened during the hearing in the Supreme Court?
The case was heard based on the report of the Registrar General of the High Court. The report said that the judge apologized unconditionally. During the hearing, the Chief Justice asked Attorney General R Venkataramani if he would like to present any argument.
On this, the Attorney General said that I had seen the clipping. I was wondering if there would be any internal action. In Bengaluru, I had talked to the lawyers not only about the judge but also about other things.
Solicitor General Tushar Mehta said that the judge has apologised. Sometimes we say something in the public domain, but now this matter should not be dragged too much.
On this, the Chief Justice said that lawyers, judges, and court members should understand that live streaming has a significant reach of the audience behind the court. This puts responsibility on the lawyers, judges, and litigants present in the court for accidental conduct with wide-reaching effects.
He further said that as judges, we have a nature based on our life experiences. Also, a judge has to be aware of his pre-nature. Only based on such awareness can we be faithful to our duty.
While closing the case against the High Court judge, the Chief Justice said that sudden comments indicate bias. We need to avoid this.
Cannot control social media- CJI
During the hearing of the case, the Solicitor General said that there are people who are using Twitter handles to comment on it. The anonymity associated with social media makes it a very dangerous tool.
On this, the Chief Justice said that you cannot call an area of this country Pakistan nor can social media be controlled.
The CJI further said that the answer to sunlight is more sunlight. The answer is not to close the doors and lock everyone in. He also clarified that the live streaming that is happening in the court cannot be stopped.
Ending the hearing of the case, CJI Chandrachud said that he has apologized, so now we are closing it.
