"Ami, don't resign"... Bengal Chief Minister Mamata Banerjee has refused to resign after losing the assembly elections. She has clearly stated that she will not step down from office. For Mamata Banerjee, or any Chief Minister, to refuse to resign even after losing an election could create a serious constitutional crisis. According to the Indian Constitution, certain steps can be taken in such a situation. It is worth noting that the term of the West Bengal Legislative Assembly expires on May 7, 2026. The Constitution states that the Chief Minister's position does not end upon the expiration of the term. The Indian Constitution clearly states the terms of office and the Chief Minister's resignation.

The Council of Ministers is accountable to the Legislative Assembly. If a Chief Minister loses an election or their party loses a majority, they no longer have the moral or legal right to remain in power.
What action can be taken if resignation is not given?
If a Chief Minister refuses to resign despite defeat, the Governor has the following action:
Dismissal from office – The Governor can dismiss the Chief Minister. Since the Chief Minister holds office during the Governor's pleasure, failing to resign after losing a majority or an election is considered a failure of the constitutional machinery, and the Governor can remove them from office.
Vote of Confidence – The Governor can ask the Chief Minister to prove her majority in the House. If she loses, she will be unable to prove her majority and can be removed through a vote of no confidence in the House.
It is clear that if Trinamool does not have a majority, the government cannot continue. Mamata can only remain as caretaker Chief Minister until the formation of a new assembly. As soon as the results are officially announced, the Governor can invite the majority party to form the government. In that case, she will have to step down.
Even if she does not resign, a new government will be formed.
Mamata Banerjee's decision not to resign will likely be symbolic, as her party has already lost the elections. The Assembly's term has ended. The Governor will invite the BJP to form the government after it becomes the largest party and secures a majority. Therefore, her refusal to resign will not prevent the transfer of power.
The tenure of the CM is also fixed.
Article 172 states that the state assembly has a maximum term of five years, and this also determines the Chief Minister's term. Article 164 states that the Chief Minister holds office "during the pleasure of the Governor," but this is in accordance with the Constitution, meaning that losing the majority automatically results in the loss of the right to hold office.
Constitutionally, a government cannot function without a majority. Therefore, whether Mamata Banerjee resigns or not will not make much difference. The transition of power will take place according to the constitutionally established process.
Then the help of security forces will be taken.
If a Chief Minister does not vacate his office even after being dismissed, security forces may be called in to maintain law and order. The office can be vacated.
Has this happened before?
No. This has never happened in Indian politics. There are no instances of a direct refusal to resign after losing an assembly election. This is against the conventions of democracy.
