In a significant judgment, the Supreme Court of India on Monday upheld the Karnataka High Court’s order that quashed the Enforcement Directorate’s (ED) proceedings against Karnataka Chief Minister Siddaramaiah’s wife BM Parvati in the controversial MUDA (Mysuru Urban Development Authority) plot allotment case. The court also gave a strong message to the ED, warning against its misuse in political matters.

Supreme Court Questions ED’s Motives

A bench headed by Chief Justice BR Gavai and Justice K Vinod Chandran did not mince words while questioning the ED’s actions. The court remarked:

“Political battles should be fought in front of voters. Why are you being used?”

The remark came during the hearing of the ED’s plea challenging the Karnataka High Court’s decision to dismiss its case against BM Parvati and state minister Byrathi Suresh. The ED alleged irregularities in the allotment of MUDA plots, but the High Court had earlier found no grounds to proceed against the two.

"Don't Force Us to Speak Harshly": SC Warns ED

When Additional Solicitor General SV Raju, appearing for the ED, attempted to argue the matter, Chief Justice Gavai firmly advised restraint.

“Raju, please do not force us to open our mouth. Otherwise, we will be forced to make some harsh comments about the ED. Unfortunately, I have some experience of Maharashtra… Political conflicts should not be spread across the country.”

This pointed statement appeared to reflect the court’s growing concern about the perceived politicization of investigative agencies, especially in cases involving opposition leaders.

High Court's Ruling Stands

The Supreme Court found no fault in the High Court’s reasoning, stating that:

“We do not find any error in the approach of the single judge. Considering the special facts and circumstances, the petition is dismissed.”

The March 2025 ruling of the Karnataka High Court had already quashed ED summons to BM Parvati and Byrathi Suresh. The Supreme Court’s latest decision has now permanently blocked ED’s action in this matter.

This judgment is being viewed as a strong rebuke to the ED’s functioning, especially in cases involving political figures from opposition parties. The SC’s remarks echo growing public and judicial concern over selective targeting and overreach by central investigative agencies.
