There has been a big change in the rules for opening shops in Uttar Pradesh, Yogi government has given a big relief to the landlords

The Uttar Pradesh government has prepared a draft of the Building Construction and Development Bye-laws-2025, which aims to free those who open shops at home from exploitation. Under this bye-law, commercial activities will be allowed on residential plots located on roads 24 meters or more wide, skyscrapers will be allowed to be built and industries will be allowed to be set up.

State Bureau, Lucknow. Now those who open shops in their homes can get freedom from all kinds of exploitation. The state government is now going to allow commercial and other types of activities (mixed land use) on residential plots situated on roads 24 meters or more wide. Now high-rise multi-storey buildings can be built on roads 45 meters or more wide. 

Similarly, industries can now be set up on the seven meter wide village roads. To ensure maximum construction on less land, the government is increasing the land coverage and FAR (floor area ratio) and is also changing and reducing the setback standards.

In view of the increasing population in urban areas and to ensure more construction on less land for other activities including residential areas, the state government has prepared a new Building Construction and Development Bye-law in place of the 17-year old Building Construction and Development Bye-law-2008. 

The committee formed at the government level to prepare new building bye-laws has prepared the Building Construction and Development Bye-laws-2025 after studying the building bye-laws of other states.

Draft of Building Bye-laws-2025 finalised

Principal Secretary Housing and Urban Planning P Guruprasad said that the draft of Building Bye-laws-2025 has been finalized. After getting the green signal from Chief Minister Yogi Adityanath, who is also in charge of the Housing Department, on Tuesday, suggestions and objections will be sought on the proposed bye-laws from Wednesday.

It is worth noting that through the proposed bye-law, the government is going to provide all kinds of facilities to the plot owners for construction of buildings for residential and other uses. 

Sources reveal that in order to provide great relief to building owners from exploitation by development authorities, the Chief Minister had directed the departmental officers to simplify all the rules in the new bye-laws and hence all the complex provisions have been removed from the proposed bye-laws. 

Such arrangements have been made that now more construction can be ensured in less space. For this, it is proposed to increase FAR up to three hundred percent as per usage by eliminating the limit of ground coverage. Along with this, the standards for leaving setback are being relaxed to a great extent by rationalizing them.

Exemption from getting map passed for construction

In the proposed bye-law, exemption is also being given from getting the map passed for construction on residential plots up to 100 square meters and commercial plots up to 30 square meters. The plot owner will have to just upload the map by registering online following certain conditions. 

All the amendments made from time to time in the Building Bye-laws-2008 have also been included in the proposed bye-laws. Keeping in mind the suggestions and objections received on the proposed bye-laws, the Housing Department will finalize the bye-laws proposal and place it before the Cabinet. 

Since a 15-day deadline has been given for suggestions and objections, the bye-law is expected to get cabinet approval in May itself. After getting the cabinet approval, the Development Authority and Housing Development Council will have to accept and implement the bye-law through their respective boards.

Along with uploading the proposed bye-laws on the departmental website, it will also be published in English-Hindi newspapers. Anyone can view the draft of Building Bye-laws-2025 on the website of Housing and Urban Planning Department awas.upsdc.gov.in, website of Town and Country Planning uptownplanning.gov.in and website of Awas Bandhu awasbandhu.in. 

Written objections and suggestions on the by-law can be sent in writing to the Chief Town and Country Planner in the Town and Country Planning Department located in Vibhuti Khand, Gomti Nagar. Objections and suggestions can also be given within 15 days through email ctcpbuildingbyelaws2025@gmail.com.
