Understanding Digilocker: The Legal Validity of Digital Lockers and IT Act Compliance

In the push towards a paperless digital economy, the Government of India launched DigiLocker under the Ministry of Electronics and Information Technology (MeitY). It serves as a flagship cloud platform for the issuance and verification of documents and certificates.
While millions use it daily to show their driving licenses to traffic police or verify academic certificates, many are unaware of the specific legal framework that gives this platform its massive authority. DigiLocker isn't just a convenient file-storage app—it carries explicit statutory backing that makes its documents legally identical to original physical paperwork.
The Legal Backbone: Rule 9A of the IT Rules
The legal validity of DigiLocker is anchored directly in Rule 9A of the Information Technology (Preservation and Retention of Information by Intermediaries Providing Digital Locker Facilities) Rules, which were formally amended and notified under the master Information Technology (IT) Act.
What Rule 9A Explicitly Declares:
"Issued documents available via the Digital Locker system, when shared by the subscriber through electronic links or through the system interface, shall be deemed to be at par with original physical documents issued by the issuing authority."
This means that any government department, public sector bank, educational institution, or private sector entity regulated by a statutory body cannot legally refuse to accept a document served via your DigiLocker interface.
"Issued" vs. "Uploaded" Documents: Crucial Distinction
To understand your legal privileges, you must understand how DigiLocker categorizes files within its architecture. Only one of these categories carries full legal equivalence:

Issued Documents (100% Legally Valid): These are digital certificates fetched in real-time straight from the source database of the issuer (e.g., CBSE, Income Tax Department, State RTOs, or LPG providers). They bear a cryptographic timestamp and a digital signature from the authority. These are the files covered under Rule 9A.

Uploaded Documents (No Automatic Legal Status): DigiLocker offers a "Drive" space where you can manually upload scanned PDFs or photos of your medical bills, certificates, or personal identity cards. Because these are self-pushed and lack independent cryptographic verification from an authority, they are viewed merely as scanned photocopies and hold no special legal weight.
Inter-Ministerial Directives: Enforcement on the Ground
To ensure compliance across various public domains, key regulators and ministries have issued explicit circulars instructing field officers to honor digital lockers:

The Transport Sector: The Ministry of Road Transport and Highways (MoRTH) issued a definitive directive to all state traffic police departments. It explicitly forbids officers from issuing challans or fines for "not carrying physical documents" if a motorist presents their digital Driving License or RC through DigiLocker or the mParivahan application.

Aviation Security: The Bureau of Civil Aviation Security (BCAS) formally permits domestic flyers to use identity proofs displayed directly via the DigiLocker interface to clear the entry gates at all national airports.

The Railway Network: Indian Railways officially accepts digital identity documents presented inside the secure app interface as valid proof of identity for passengers traveling in all classes.

Because DigiLocker connects directly to your core citizen record databases, it adheres to high-tier national security protocols:
